CBEC Clarification on difficulties related to filling of Bill of Entry

(Ref Notification  no. 26/2017-Cust & Notification  no. 27/2017-Cust all  dated 31/03/2017)

 

Dear Members,

 

Kindly note that CBEC has issued clarification  vide  Instruction No.450/10/2017-CUSIV dated 31/08/2017  regarding relief  from penalty on   bona-fide cases were B/E filling delay has happened due to ICEGATE/ system issue.

 

As you might  be aware,  earlier CBEC had issued Notification  no. 26/2017-Cust & Notification  no. 27/2017-Cust all  dated 31/03/2017   wherein  the importer/ authorised person had to file the bill of entry before the end of the next day following the day (excluding holidays) on which the aircraft or vessel or vehicle carrying the goods arrives at a customs station at which such goods are to be cleared for home consumption or warehousing.  Where the bill of entry is not filed within the time specified in sub regulation (1) and the proper officer of Customs is satisfied that there was no sufficient cause for such delay, the importer shall be liable to pay charges for late presentation of the bill of entry at the rate of rupees five thousand per day for the initial three days of default and at the rate of rupees ten thousand per day for each day of default thereafter.  In this regard, council had also sent a representation to CBEC for suitable changes/ relief. 

 

Now as  an “Ease of doing Business measure”, CBEC  has issued this clarification to field formations to take a lenient view/ provide relief  from penalty in  genuine  cases were B/E filling delay has happened due to ICEGATE/ system issue.
