Dear Members,

 

We would like to inform you that  the O/o Commissioner of Customs (NS-IV),  Zone–II, JNCH   has issued Public Notice no. 48/2019 dated 27/05/2019  regarding  Procedure of import cargo for non-insecticidal use under CIB permit.

 

We understand from above Public Notice that some importers are importing goods (pesticides/fungicide and other items of Chapter 38 which require CIB permit) in anticipation of CIB permit on the basis of their application.

 

After the imported goods have arrived, they request for warehousing of the goods pending CIB permit.” As per the FTP 2015-20 para 2.36 (a) Private/ Public bonded warehouses may be set up in DTA as per rules, regulations and notifications issued under the Customs Act, 1962. Any person may import goods except prohibited items, arms and ammunition, hazardous waste and chemicals and warehouse them in such bonded warehouses. Thus warehousing of Hazardous chemicals is not permitted by FTP. Therefore, the containers are stuck up and causes delay in clearance of the cargo.

 

Therefore, it has been decided that the import of such goods should only be done after obtaining CIB permission in advance and the warehousing of the goods shall not be allowed as per the FTP 2015-20 para 2.36(a).
