We are pleased to inform you that Chemexcil in association with our knowledge partners M/s. Lakshmikumaran & Sridharan Attorneys is organising Seminars on “Decoding SCOMET” & “AEO under Customs Law” respectively on 22/06/2018 in Mumbai.
As you might be aware, SCOMET, an acronym for Special Chemicals Organisms, Materials, Equipment and Technology, is a comprehensive list of materials, equipment and technology (including software) that are subject to vigorous export controls in India. These goods in the opinion of international governments can have dual-use (military and civil use, and could also be misused for terrorist activities) and therefore their export should be subject to the strictest scrutiny before being cleared. The Primary requirement for export in these cases is an export permit or a licence known as a SCOMET licence. The final decision on the ‘dual-use’ capability lies with the Government. However, routine export consignment may face delays if the enforcement agency (Customs / DRI) takes the view that the export goods may require a SCOMET licence. It should also be noted that penal consequences for non-compliant exports are very severe.
Further, AEO (Authorized Economic Operator) programme is currently being debated by industry. The newly created Directorate of International Customs (DIC), is actively supporting Importers, Exporters and LO’s. Mutual Recognition Arrangement (MRA) between countries are also getting signed under bi-lateral agreements. However, in spite of tangible cost reduction and turnaround time reduction, many concerns, misconceptions about this Global Programme introduced under the WTO’s Trade Facilitation Agreement (TFA) remain.
The objective of this Twin Seminar session is to apprise the members-exporters about the challenges of SCOMET & AEO and also get their queries addressed by the distinguished experts from Lakshmikumaran & Sridharan Attorneys.
