(CUSTOMS) Recovery of Govt. Dues under section 142 of Customs Act 1962 -Regarding.

 

Dear Sir

 

Enclosed herewith is the Public Notice no. 8 /2023 issued by Office of the Commissionaire of the Custom (Export) Tax Recovery cell vide letter no. F. No. GEN/TAR/RA/1522/2022-TAR dated 9th March-2023.

 

Background:

 

As per notice some of the Exporters/Custom Brokers/All stakeholders of the trade have not paid the duties, interest, penalties while executing the trade w.r.t. customs arrears at air cargo complex Mumbai.

 

QUOTE:

 

There are 1434 exporters who have not paid Govt. duties, interest, penalties. Check the notice thoroughly for the name of the exporter.

 

Purpose:

 

To sensitize all exporters/their CHA’s that in case their name figures in the list attached to this Public Notice, they should immediately contact/email to Dy./Asst. Commissioner of Customs, TRC (X) at trcexport-acc@gov.in before 18.03.2023 on working days and clear all the Govt. dues with Applicable Interest and Penalty.

 

Consequence:

 

In case the dues remain unpaid, it would attract strict recovery action under section 142 (1) c (ii) i.e., attachment of Movable and Immovable assets of defaulters.

 

 

Note:

 

In case if the exporters name is appearing in the list of this public notice and the exporter has already cleared the govt. dues with applicable interest and penalty or has filed appeal against the Order-in-Original at any legal forum (Commr. Appeal, JS RA, CESTAT, High Court), the same may be communicated to the section with relevant documents.
