Important Advisory for CHEMEXCIL Members on Compliance and Visits by Overseas Government Officials under FTAs

 

Dear Members,

As you are aware, the Department has signed Free Trade Agreements (FTAs) with many countries and is in the process of signing similar agreements with other countries also. 

These FTAs provide preferential access to the markets by reducing tariff barriers resulting in enhancing market access for Indian chemical exporters.

As part of ensuring compliance with FTA rules and maintaining these benefits, overseas government officials such as customs officers and regulatory representatives (of importing countries) generally conducts verification visits to the premises of exporting companies. 

The aim of this visit is 

  • To validate the origin of product.

  • Manufacturing processes, and 

  • Regulatory compliance of exported goods to respective countries under FTA provisions.

To help our members to prepare for such visits and ensure full compliance, we suggest members to note the following. 

1. Maintain accurate, complete, and up-to-date documentation records of  

  • Certificates of Origin, 

  • Manufacturing records, 

  • Commercial invoices, 

  • Packing lists, 

  • Material Safety Data Sheets (MSDS), 

  • Product registration certificate, 

  • Any other relevant information, etc. 

2. Ensure compliance with the importing country’s chemical safety, labeling, and regulatory standards.

3. Cooperate for transparent and timely access to premises and records during their inspections.

4. Train your staff to understand FTA requirements and be ready to respond to the queries asked by visiting officials during your plant/office visit.

5. Keep records of any visits for internal audit for future reference.

Please note any discrepancies, short fall, dissatisfied documents, proofs will lead to denial of preferential tariffs and penalties to the concerned Exporters
