Dear Sir/Madam,

Council is in receipt of communication from Department of Commerce informing as under :-

It has been decided by the Government to review all pre­ Independence Acts. 

Accordingly,  the Poisons Act,  1919 which regulates the possession,  sale  and transportation of poisons, is being reviewed for its re-enactment. 

In this regard,  it is requested that comments/inputs for any addition/deletion/amendments in Poisons Act,1919 and Model Poisons Rules 2013 for proposed draft Poisons Bill,  2023, may please be furnished to department ASAP. 

Enclosed herewith are

• The copy of Poisons Act,1919 and Model Poisons Rules, 2013
•  
• A copy of an advisory dated 12th August, 2021 issued by MHA to all State Governments/Union Territories regarding granting exemption to industries covered under the Manufacture, Storage and import of Hazardous Chemicals (MSIHC)  Rules,1989, from the provisions under the Poisons  Act,  1919 for ready reference.
•  
• List of poisons (FYI these chemicals are coming under the purview of Chemexcil)

In view of above we request concerned member to furnish inputs for any addition/deletion/amendments in Poisons Act,1919 and Model Poisons Rules 2013 if any, on or before 24th February 2023 to  ed@chemexcil.in with copy to pw@chemexcil.in
