To,
ALL MEMBERS OF THE COUNCIL

Increased Frequency of Compliance Checks for Calcium Carbonate as

per EU implementing regulation published on 12 June 2024

Dear Sir/Madam

CHEMEXCIL is in receipt of email communication from Department of Commerce, Govt. of India attaching a regulatory notification received from Embassy of India, Brussels informing that the European Commission has increased the frequency of checks on Calcium Carbonate (Food & Feed use) as per attached Implementing Regulation - EU - 2024/1662 - EN - EUR-Lex (europa.eu) effective from 12th June 2024.

The Regulation will come into force on 2nd July 2024.

It amends the Implementing Regulation (EU) 2019/1793 on the temporary increase of official controls and emergency measures governing the entry into the Union of certain goods from certain third countries implementing Regulations (EU) 2017/625 and (EC) No 178/2002 of the European Parliament and of the Council.

Notifications were received through the Rapid Alert System for Food and Feed (‘RASFF’) and official controls performed by the Member States indicated the existence of serious direct or indirect risk to human health deriving from certain food or feed.

Hence, in order to protect human health in the Union, it was indicated that the lists set out in Annexes I and II to Implementing Regulation (EU) 2019/1793 should be amended.

As of result of above, Calcium carbonate of Indian origin for intended use in Food and feed is added under the ANNEX II to the Implementing Regulation (EU) 2019/1793 due to contamination risk by pesticide residue in it.

Therefore, it will be subject to special conditions for entry into the EU.

The Frequency of identity and physical checks by European Commission for Calcium Carbonate will be at 30%.

If non-compliance persists, it could lead to a suspension of imports of calcium carbonate from India resulting in significant impact on India’s exports.

Concerned members are therefore requested to go through the attached regulatory notification and  take the necessary actions to ensure compliance.

Thanks and Regards

Raghuveer Kini
