The European Commission (EC) has launched a public consultation with the objective of revising the Regulation on the classification, labelling and packaging of chemical substances and mixtures ( CLP Regulation (Regulation (EC) No 1272/2008) to improve in the EU the safe use of chemicals and to simplify existing CLP rules.
The revision of the CLP Regulation was announced by the Chemical Strategy adopted on 14 October 2020 as the first step towards the zero pollution ambition (copy attached). The consultation seeks to gather the views of citizens, institutions and organizations from the public and private sectors on how to best revise the CLP Regulation taking into account scientific and technical progress.
The CLP Regulation is the central piece of legislation used in the EU to identify and communicate the hazardous properties of chemicals stems from the United Nations’ global standard (GHS) and enacts this standard into EU law. It sets out how to classify chemicals which are hazardous (e.g. as carcinogenic or hazardous to the aquatic environment) and how to communicate those hazards across supply chains and to consumers and workers.
The EC will examine different measures and options to introduce new hazard classes (such as endocrine disruption as well as persistency, bioaccumulation & toxicity and persistent, mobile and toxic chemicals) and corresponding classification criteria.
As implication, the revised EU CLP regulation will require importers and downstream users to submit information on substances classified for physical effects or health hazards and clarify obligations for distributors to submit such information, through an only representative or other means.
The Commission is currently undertaking an impact assessment to decide on the most appropriate way forward and has launched a public consultation as part of this exercise. The European Commission has developed an online questionnaire that consists of two sections: one with more general questions, and the other with more expert questions (altogether 48 questions). Based on the public consultation and the impact assessment, the Commission will come up with a revised CLP regulation.
