DCPC Advisory Regarding USEPA Notification on Import of Certain Chemical Substances from the United States to India

Dear Member,
CHEMEXCIL wishes to inform its members that the Department of Chemicals and Petrochemicals (DCPC), Ministry of Chemicals and Fertilizers, Government of India, has circulated a communication dated 04 June 2026 regarding a notification received from the United States Environmental Protection Agency (USEPA) concerning the export of certain chemical substances from the United States to India under the Toxic Substances Control Act (TSCA).
The notification pertains to the following chemical substances:
1. Chromic Acid (H2CrO4), Chromium (3+) Salt (3:2)
2. Dialkyl Phosphorodithioate Phosphate Compounds (Generic) (P-90-1642)
3. 2-Pyrrolidinone, 1-butyl
The USEPA has informed the Government of India that the above-mentioned substances are being exported from the United States to India in accordance with Section 12(b) of the Toxic Substances Control Act (TSCA). Such notifications are issued when chemical substances are subject to regulatory actions under U.S. environmental legislation.
Members may note that these substances are subject to specific regulatory requirements under TSCA, including:
• Section 5(e) Orders
• Significant New Use Rules (SNURs)
In the present case, USEPA issued a Section 5(e) Order for the concerned substance on 26 November 1990, followed by a Final Significant New Use Rule (SNUR) on 13 August 1991 due to potential concerns relating to human health and environmental protection.
Under the SNUR provisions, any entity intending to manufacture, import, or process the concerned substance for a designated significant new use is required to notify the USEPA at least 90 days prior to commencement of such activity. This enables the USEPA to evaluate the proposed use and, where necessary, impose restrictions or prohibit the activity before it begins.
