Invitation for Inputs on Proposed Rules of Origin Criteria under India–Canada CEPA

Dear Member,
Kind reference is invited to the ongoing negotiations between India and Canada for the proposed India–Canada Comprehensive Economic Partnership Agreement (CEPA), particularly with regard to the Rules of Origin (ROO) chapter.
The Department of Commerce has proposed the adoption of twin criteria of “Change in Tariff Subheading (CTSH) + Value Addition” for tariff lines where Canada maintains zero MFN duty, as an initial offer for the Product Specific Rules (PSR) negotiations. However, the percentage of value addition has not been explicitly indicated at this stage.
An Excel sheet containing 506 tariff lines where the above twin criteria have been proposed is being shared for reference. In this regard, member-exporters are requested to kindly examine the proposed CTSH + Value Addition criteria and provide their feedback/concerns, if any, particularly with respect to the feasibility and impact of the proposed criteria on exports of chemicals, cosmetics, dyes and allied products.
Members are also requested to provide specific suggestions regarding the percentage of value addition that would be achievable and commercially feasible, keeping in view India’s export interests and the competitiveness of Indian products in the Canadian market.
The inputs may kindly be shared at the earliest, preferably by 5 September 2026, at ed@chemexcil.in, with a copy to amrita@chemexcil.in, shalini@chemexcil.in and ad.del@chemexcil.in, to enable the Council to compile and forward the industry’s views to the concerned authorities.
Members are requested to kindly accord priority to the matter and provide their valuable inputs within the stipulated timeline.
