Dear Sirs,
As you are aware, the Council has
adopted the new Bye Laws/Articles, framed by the Central Government in its
Extra-Ordinary General Meeting held on 8th February, 2002. As per para 3
of the new Bye Laws only Ordinary members are eligible to vote.
3.2
Associate Member
A person shall be eligible for admission to the
Council as Associate Member, on receiving the Import-Export Code Number
from the Director General Foreign Trade, Government of India, in respect
of the product with which the Council is concerned.
3.3. Ordinary
Member
In order to be eligible for ordinary member of the Council,
a person must satisfy the following requirements, namely:
(a) He,
or the entity represented by him, must have been an associate Member of
the Council for at least three years. (b) He, or the entity represented by
him, must have, to his or its credit, during the three financial years
immediately preceding average exports in
respect of the product of
not less than the amount mentioned below :
(i ) Small Scale
Industries - Rs. 10 Lakhs
(ii) Others - Rs. 25 Lakhs

: ELIGIBILITY FOR ELECTIONS
4.1 Right to Vote etc. confined to
ordinary members
Only an ordinary member shall have the right to
vote at, or to offer self as a candidate at elections to various positions
in the Council.
4.2 Eligibility of Ordinary members
A
candidate for election to any position in the Council must satisfy the
following conditions, namely;
a) He, or the entity represented by
him, must have to his or its credit, during the one financial year
immediately preceding exports of the products falling under purview of
Council of not less than the amount mentioned below:
i. Small
Scale Industries : Rs.25 Lakhs
ii. Others : RS. 1 Crore
b)
Where a person is standing for the election as Chairman or Vice-Chairman
or Regional Chairman, etc., he, or the entity represented by him, must
have to his or its credit, during the one financial year immediately
preceding, exports of the product falling under purview of Council not
less than Rupees 2 crores.
Candidate should represent the Industry
which is member of the Council for the products coming under the purview
of Council.
c) Candidate applying for nomination for election
should submit Bank Certificate of realization in support of their
fulfillment of condition under Para 4.2 (b) wherein products & FOB
value of exports are given.
The Company engaged in exports of
multiple products should have more than 75% of total exports of the items
coming under the purview of the Council and should comply with
requirements of para 4.2(a).
Also member contesting election should
be predominantly exporter of the items coming under the purview of the
Council.

Ordinary members
interested and fulfilling above conditions should submit their nomination
for contesting the election to the Committee of Administration of the
Council, as per the specimen given at Annexure –I along with following
details:
(a) A statement of exports for three preceding financial
years i.e. 2012-13, 2013-14 & 2014-15 duly certified by a Chartered
Accountant; duly supported by Bank Realization Certificate in support of
their fulfillment of condition under Para 4.2.
(b) The firm/Company
represented by the proposer and the firm/company represented by the
nominee should be members of the Council from the same Panel and both of
them should have paid membership subscription for immediate past three
years i.e. 2012-13, 2013-14 & 2014-15 and also for the current year
i.e. 2015-16 on or before 30/06/2015.
(c) It may be please noted
that Member-exporters fulfilling the above conditions will be eligible to
exercise their right of franchise.
The sealed cover containing the
nomination papers and duly superscripted on the top as ‘NOMINATION FOR
ELECTION” may be sent to the undersigned by hand-delivery or by Registered
Post so as to reach the same to him on or before Tuesday, the 10th
November, 2015 by 3.00 p.m. Nomination received after the due date, and
time shall not be considered. Those nominations which are not in
accordance with this notice/specimen nomination form shall be treated as
invalid.
Withdrawal of nomination will be allowed on or before
Tuesday, the 17th November, 2015 by 3.00 p.m and Panel wise list of
candidates contesting the election will be finalized
thereafter.
