TBT notification issued by Saudi Arabia on technical

requirements for Cosmetics

Dear Sir/ Madam,

The Council has received information from M/s. APJ-SLG Law Offices, New Delhi regarding  TBT notification no. G/TBT/N/SAU/850 dated 25th June 2015  issued by Saudi Arabia on requirements for cosmetics.

Brief of the Regulation:

This regulation is concerned with criteria of cosmetic products claims, and it describes the basic criteria of acceptable claims of cosmetics products. This regulation includes examples (not exhaustive) of the unacceptable claims of cosmetic products. Products containing claims of violation of this regulation may come out of the scope of cosmetic preparation.

Claims for cosmetic products, whether explicit or implicit, shall be supported by adequate and verifiable evidence released by the manufacturer.  This requires the possibility of linking between references studies used as evidence and product used by the claim and It should use scientific methods to prove a well designed and followed (true, reliable and rechargeable experience), and respects the ethical considerations.

Fine fragrances usually contain such a high amount of alcohol that the additional use of preservatives is not necessary. In this case, it would be dishonest to highlight in advertising the fact that a certain fine fragrance does not contain any preservatives. The list of unacceptable claims has been listed in the regulation.  More details are provided with document attached with the mail.

Since India exports these products to Saudi Arabia, hence, the regulation if implemented, may impact India’s exports to this market.

Members are requested to  take note of the same and may also send their comments to the Council,   so that the same could be submitted to M/s. APJ-SLG Law Offices, New Delhi for further action.

Thanking You,

Yours faithfully,

( S.G.BHARADI )
ACTG. EXECUTIVE DIRECTOR
